Code, State Personnel and Pensions § 21–209","heading":"","body":"(a) (1) Notwithstanding any other law, a person may not serve as a fiduciary if the person has been convicted of:\n(i) a felony;\n(ii) a misdemeanor involving moral turpitude;\n(iii) a violation of this subtitle;\n(iv) a conspiracy or attempt to commit a crime described under item (i), (ii), or (iii) of this paragraph; or\n(v) a crime in which a crime described under item (i), (ii), (iii), or (iv) of this paragraph is an element.\n(2) A person may not knowingly allow another person to serve as a fiduciary in violation of paragraph (1) of this subsection.\n(b) Any person who intentionally violates subsection (a) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $10,000 or imprisonment not exceeding 1 year or both.\n(c) For the purposes of this section, a person is deemed to be convicted on the later of:\n(1) the date of judgment of the trial court; or\n(2) the date of the final sustaining of judgment on appeal.\n(d) A fiduciary may be removed for a violation of subsection (a) of this section.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=21-209","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"d390af8f52d53d2142c5624a9d7e2d58382e84385243d7d45d6cd96e241b4cdc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-21-208","next":"us-md/md.-code-state-personnel-and-pensions-21-210"},"notice":"GroundRules: Original legal text.
