Code, State Personnel and Pensions § 21–406","heading":"","body":"(a) (1) If a designated beneficiary who is receiving payments for life dies on or before the 15th day of a month, the Board of Trustees may not pay any portion of the designated beneficiary’s allowance to the designated beneficiary’s estate for the month in which the death occurs.\n(2) If a designated beneficiary who is receiving payments for life dies on or after the 16th day of a month, the Board of Trustees shall pay to the designated beneficiary’s estate the entire allowance due to the designated beneficiary for the month in which the death occurs.\n(b) (1) If a retiree dies on or before the 15th day of a month, the Board of Trustees may not pay any portion of the retiree’s allowance to the designated beneficiary or the retiree’s estate for the month in which the death occurs.\n(2) If a retiree dies on or after the 16th day of a month, the Board of Trustees shall pay the entire allowance due to the retiree for the month in which the death occurs:\n(i) to the designated beneficiary; or\n(ii) if there is no designated beneficiary, to the retiree’s estate.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=21-406","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"b46a64b6295c6b62f7bf4ff49151c6417516d9ae68c6aef625adf4de4d248fe3","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-21-405","next":"us-md/md.-code-state-personnel-and-pensions-21-501"},"notice":"GroundRules: Original legal text.
