Code, State Personnel and Pensions § 22–308","heading":"","body":"(a) Creditable service on which the allowance of a member is based consists of:\n(1) eligibility service, except as provided in subsection (b) of this section; and\n(2) credit for unused sick leave as provided in § 20-206 of this article.\n(b) (1) Except as provided in paragraph (2) of this subsection, a member’s creditable service for a period of regular part-time employment equals the member’s actual employment during that period.\n(2) Subject to paragraph (3) of this subsection, a member’s creditable service for a period of regular part-time employment equals the member’s eligibility service for that period if:\n(i) the medical board determines that the member’s part-time employment is a result of a medically determined disability that prevents full-time work; and\n(ii) the member then elects to make the contributions for full-time employment required by § 22-214 of this title.\n(3) Except to the extent that a disability was aggravated after a member’s enrollment, paragraph (2) of this subsection does not apply to a disability incurred before a member’s enrollment.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=22-308","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"ecf77d30d309132199982d664a498a82a8a50e30531751db6af30504c65745f1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-22-307","next":"us-md/md.-code-state-personnel-and-pensions-22-401"},"notice":"GroundRules: Original legal text.
