Code, State Personnel and Pensions § 22–402","heading":"","body":"(a) A member may retire with an early service retirement allowance if:\n(1) on or before the date of retirement, the member:\n(i) has at least 25 but less than 30 years of eligibility service; and\n(ii) is less than 60 years old; and\n(2) the member completes and submits a written application to the Board of Trustees stating the date when the member desires to retire.\n(b) On retirement under this section, a member is entitled to an early service retirement allowance that equals one fifty-fifth of the member's average final compensation multiplied by the number of years of creditable service reduced by 0.5% for each month by which the member's date of retirement precedes the earlier of:\n(1) the date the member will be 60 years old; or\n(2) the date the member would have completed 30 years of eligibility service had the member continued employment.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=22-402","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"c034efbad2fad7d2b7eda56ea283440d3cf2008bc067c7821133586e39cb8176","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-22-401","next":"us-md/md.-code-state-personnel-and-pensions-22-403"},"notice":"GroundRules: Original legal text.
