Code, State Personnel and Pensions § 23–215","heading":"","body":"(a) Except as provided in § 23–215.1 of this subtitle, membership ends if the member:\n(1) is separated from employment for more than 4 years;\n(2) is separated from employment, and rehired into a position that requires enrollment in a part of the Employees’ Pension System or the Teachers’ Pension System that is subject to a different rate of member contributions and benefit accrual;\n(3) withdraws the member’s accumulated contributions;\n(4) becomes a retiree; or\n(5) dies.\n(b) Subsection (a)(2) of this section does not apply for purposes of determining eligibility for a disability retirement benefit under § 29–104(a) of this article.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=23-215","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"4a01b7b6a967b22e753fbea50403eb79580726d6892cbb9d329d70d7fb10f718","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-23-214","next":"us-md/md.-code-state-personnel-and-pensions-23-215.1"},"notice":"GroundRules: Original legal text.
