Code, State Personnel and Pensions § 23–217","heading":"","body":"(a) Except as provided in subsection (b) of this section, this Part II of this subtitle applies to an individual who is:\n(1) a member of the Employees’ Pension System or the Teachers’ Pension System; or\n(2) a member of the Employees’ Retirement System or the Teachers’ Retirement System subject to Selection C (Combination Formula) as provided in § 22-221 of this article.\n(b) This Part II of this subtitle does not apply to an individual who is:\n(1) an employee of:\n(i) a participating governmental unit that has not elected the contributory pension benefit for its employees under § 31-116 of this article; or\n(ii) a former participating governmental unit, other than Frederick County, that has withdrawn;\n(2) a member of the Employees’ Pension System or Teachers’ Pension System who transferred from the Employees’ Retirement System or Teachers’ Retirement System after April 1, 1998; or\n(3) a member who is subject to the Alternate Contributory Pension Selection under Part III of this subtitle.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=23-217","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"45a0a4bb04b21c72dbd4dfe1195ebd59bc9b20a2ba4666a77b47a4443a3a58a5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-23-215.2","next":"us-md/md.-code-state-personnel-and-pensions-23-218"},"notice":"GroundRules: Original legal text.
