Code, State Personnel and Pensions § 25–201","heading":"","body":"(a) Except as provided in subsection (b) of this section, this subtitle applies only to:\n(1) correctional officers serving in any of the first six job classifications;\n(2) security attendants at Clifton T. Perkins Hospital Center;\n(3) a detention center officer employed by a participating governmental unit that on or after July 1, 2006, has elected to participate in the Correctional Officers’ Retirement System;\n(4) an individual serving as a correctional dietary, maintenance, laundry, or supply officer;\n(5) an individual serving as a Maryland Correctional Enterprises officer, officer trainee, plant supervisor, plant manager, or regional manager;\n(6) a correctional officer serving as a security chief, a facility administrator, an assistant warden, or a warden who:\n(i) begins employment in that position on or after July 1, 2014; or\n(ii) is serving in that position on June 30, 2014, and elects to transfer to the Correctional Officers’ Retirement System from:\n1. the Employees’ Pension System on or before December 31, 2014; or\n2. the Employees’ Retirement System on or before December 31, 2015;\n(7) an individual serving as a correctional case management specialist, supervisor, or manager on or after July 1, 2016;\n(8) an individual serving as a parole and probation agent, supervisor, or regional administrator on or after July 1, 2017;\n(9) an individual serving as a Department of Public Safety and Correctional Services employee in one of the following positions on or after July 1, 2017:\n(i) an alcohol and drug:\n1. associate counselor, counselor lead, counselor provisional, or counselor supervisor;\n2. professional counselor, counselor provisional, or counselor supervisor; or\n3. supervised counselor or counselor provisional;\n(ii) a mental health professional counselor, graduate professional counselor, professional counselor advanced, or professional supervisor;\n(iii) a psychologist, psychology associate, or psychology associate doctorate;\n(iv) a social worker, social worker advanced, social worker supervisor, or social work regional supervisor; or\n(v) a recreation officer or supervisor;\n(10) an individual serving as a Department of Juvenile Services employee in one of the following positions on or after July 1, 2018:\n(i) a community detention officer or community detention supervisor;\n(ii) a youth transportation officer, youth transportation officer lead, youth transportation officer supervisor, or youth transportation officer trainee;\n(iii) a resident advisor, resident advisor lead, resident advisor supervisor, or resident advisor trainee; or\n(iv) a youth recreation specialist;\n(11) an individual serving as a Department of Public Safety and Correctional Services employee in one of the following positions on or after July 1, 2018:\n(i) a parole and probation assistant regional administrator;\n(ii) a psychology services chief;\n(iii) a correctional maintenance officer supervisor;\n(iv) a correctional maintenance officer manager;\n(v) a correctional maintenance services officer;\n(vi) a correctional maintenance services supervisor;\n(vii) a correctional maintenance services manager; or\n(viii) a correctional maintenance regional manager;\n(12) an individual serving as a Department of Juvenile Services employee in one of the following positions on or after July 1, 2022:\n(i) a case management specialist I, II, or III;\n(ii) a case management specialist supervisor;\n(iii) a case management specialist program supervisor; or\n(iv) a group life manager I or II;\n(13) an individual serving as a Maryland Department of Health employee on or after July 1, 2024:\n(i) at one of the following facilities:\n1. Eastern Shore Hospital Center;\n2. Thomas B. Finan Center;\n3. Potomac Center/Secure Evaluation and Therapeutic Treatment Program;\n4. Spring Grove Hospital Center;\n5. Springfield Hospital Center;\n6. Regional Institute for Children and Adolescents – Baltimore; or\n7. John L. Gildner Regional Institute for Children and Adolescents; and\n(ii) in one of the following positions:\n1. a CAMH associate I, II, or lead – CI;\n2. a developmental disability associate – CI;\n3. a direct care assistant I or II – CI;\n4. a direct care trainee – CI;\n5. a licensed practical nurse I, II, III advance, or III lead – CI;\n6. a resident associate SETT – CI;\n7. a security attendant I, II, or III;\n8. a security attendant manager I or II; or\n9. a security attendant supervisor; and\n(14) an individual serving as a Maryland Department of Health employee on or after July 1, 2025:\n(i) at a facility described in item (13)(i) of this subsection; and\n(ii) in one of the following positions:\n1. a CAMH associate supervisor – CI;\n2. a developmental disability associate assistant manager – CI;\n3. a developmental disability associate manager – CI; and\n4. a developmental disability associate supervisor – CI.\n(b) This subtitle does not apply to:\n(1) an employee of the Baltimore City Jail as of June 30, 1991, who:\n(i) became an employee of the Baltimore City Detention Center on July 1, 1991; and\n(ii) did not elect to become a member of the Correctional Officers’ Retirement System on that date;\n(2) a detention center officer employed by a participating governmental unit as a local detention center officer on the effective date of participation on or after July 1, 2006, who did not elect to become a member of the Correctional Officers’ Retirement System within 6 months of the effective date of participation; or\n(3) a correctional officer serving as a security chief, a facility administrator, an assistant warden, or a warden who is in that position on June 30, 2014, and does not elect to transfer membership to the Correctional Officers’ Retirement System from:\n(i) the Employees’ Pension System on or before December 31, 2014; or\n(ii) the Employees’ Retirement System on or before December 31, 2015.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=25-201","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"dec42d9efbf862e65276ea8f0429075bebe66f467c5e811a2aa084917f0ea6ad","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-25-102","next":"us-md/md.-code-state-personnel-and-pensions-25-202"},"notice":"GroundRules: Original legal text.
