Code, State Personnel and Pensions § 25–402","heading":"","body":"(a) This section applies to a former member who:\n(1) was eligible for a retirement allowance under § 25-401 of this subtitle when the former member’s membership terminated;\n(2) did not submit a written application under § 25-401 before membership terminated; and\n(3) has not withdrawn accumulated contributions.\n(b) (1) A former member described in subsection (a) of this section may retire with a retirement allowance under § 25-401 of this subtitle on the first day of the month after the Board of Trustees receives a written application for retirement from the former member.\n(2) A former member who retires under this section may not receive benefits for the period before the former member submits a completed application to the Board of Trustees.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=25-402","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"2145295eb645ca90b51a95bc4ed021962c869588e241bfbb3be9948bd5586c3a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-25-401.1","next":"us-md/md.-code-state-personnel-and-pensions-25-403"},"notice":"GroundRules: Original legal text.
