Code, State Personnel and Pensions § 27–401","heading":"","body":"(a) (1) This subsection applies only to an individual who is a member of the Judges’ Retirement System on or before June 30, 2012.\n(2) A member or former member is entitled to a retirement allowance:\n(i) on termination of service, if the member is at least 60 years old;\n(ii) on the recommendation of the medical board, if the member or former member resigns because of disability;\n(iii) when retired by order of the Supreme Court of Maryland; or\n(iv) at the age of 60 years, if the former member’s termination of service occurred earlier.\n(b) (1) This subsection applies only to an individual who becomes a member of the Judges’ Retirement System on or after July 1, 2012.\n(2) A member or former member is entitled to a retirement allowance:\n(i) on termination of service, if the member is at least 60 years old and has at least 5 years of eligibility service;\n(ii) on the recommendation of the medical board, if the member or former member resigns because of disability;\n(iii) when retired by order of the Supreme Court of Maryland, if the member has at least 5 years of eligibility service;\n(iv) at the mandatory retirement age required by Article IV, § 3 of the Maryland Constitution with less than 5 years of eligibility service, if the member has eligibility service equal to the mandatory retirement age required by Article IV, § 3 of the Maryland Constitution minus the member’s age when the member first becomes a member; or\n(v) at the age of 60 years, if the former member’s termination of service occurred earlier and the former member had at least 5 years of eligibility service when the former member terminated service.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=27-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"2b24e9508fd7b725584c3e5bb21f12d840ade5037fc38d55c7398a6e4403fcc4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-27-303","next":"us-md/md.-code-state-personnel-and-pensions-27-402"},"notice":"GroundRules: Original legal text.
