Code, State Personnel and Pensions § 29–106","heading":"","body":"(a) This section applies only to members of:\n(1) the Correctional Officers’ Retirement System;\n(2) the Employees’ Retirement System; and\n(3) the Teachers’ Retirement System.\n(b) An ordinary disability retirement allowance equals the greater of:\n(1) a normal service retirement allowance; or\n(2) the amount computed under subsection (c) or (d) of this section.\n(c) If a member is at least normal retirement age, the amount to be used under subsection (b)(2) of this section is 25% of the member’s average final compensation.\n(d) If a member is under normal retirement age, the amount to be used under subsection (b)(2) of this section is the lesser of:\n(1) 25% of the member’s average final compensation; or\n(2) the normal service retirement allowance that is computed by using:\n(i) the number of years of creditable service that the member would have received if the member continued employment until normal retirement age; and\n(ii) an average final compensation that the member would have received if the member continued employment without a change in earnable compensation.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=29-106","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"0c1f77cd6fe451420c0e8d53eccf9f7a8c38e48f11dfae28ca1898804912e5f2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-29-105","next":"us-md/md.-code-state-personnel-and-pensions-29-107"},"notice":"GroundRules: Original legal text.
