Code, State Personnel and Pensions § 29–302.1","heading":"","body":"(a) This section applies only to an individual who:\n(1) is a former member of:\n(i) the Employees’ Retirement System; or\n(ii) the Teachers’ Retirement System;\n(2) is eligible to receive a vested allowance under § 29-302 of this subtitle; and\n(3) has not elected to receive a benefit under § 29-302 of this subtitle.\n(b) Notwithstanding § 29-302 of this subtitle, an individual under subsection (a) of this section may elect a lump-sum payment equal to the present value of the individual’s vested allowance if:\n(1) the vested allowance is less than $50 a month;\n(2) (i) the individual is not a member of the Optional Retirement Program and has terminated any employment with a participating employer for the State; or\n(ii) the individual is a member of the Optional Retirement Program and has terminated employment with an employing institution as defined in § 30-101(e) of this article; and\n(3) the individual requests a lump-sum payment of the vested allowance on a form provided by the State Retirement Agency.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=29-302.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"dc4b036314658deea762a8ee07ff1d830ea664e01eafc7785c7ffeace533e910","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-29-302","next":"us-md/md.-code-state-personnel-and-pensions-29-303"},"notice":"GroundRules: Original legal text.
