Code, State Personnel and Pensions § 29–305","heading":"","body":"(a) In this section, “constitutional officer” means:\n(1) the Attorney General of the State;\n(2) the Comptroller of the State;\n(3) the Lieutenant Governor of the State;\n(4) the Secretary of State; or\n(5) the Treasurer of the State.\n(b) (1) A constitutional officer who is a member of the Employees’ Pension System:\n(i) on taking office, has immediate vesting rights in the Employees’ Pension System; and\n(ii) except as provided in paragraph (2) of this subsection, is entitled to a retirement allowance as provided in Title 23, Subtitle 4 of this article.\n(2) The retirement allowance of a constitutional officer who serves at least one full term may not be less than 10% of the annual salary received during the constitutional officer's last term.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=29-305","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"423ff15f9c0cd1dfd9a82b53e763739f4252ad04bb0e9c9f5f0f60db68b36099","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-29-304","next":"us-md/md.-code-state-personnel-and-pensions-29-401"},"notice":"GroundRules: Original legal text.
