Code, State Personnel and Pensions § 31–112","heading":"","body":"(a) Subject to subsection (b) of this section, an employee of a participating governmental unit who is a member of one of the employees’ systems is entitled to the benefits to which State employees are entitled under that system.\n(b) (1) An employee of a participating governmental unit that has elected to participate in:\n(i) the contributory pension benefit option under § 31-116 of this subtitle shall be subject to Title 23, Subtitle 2, Part II of this article; or\n(ii) the Alternate Contributory Pension Selection under § 31-116.1 of this subtitle shall be subject to Title 23, Subtitle 2, Part III of this article.\n(2) An employee of a participating governmental unit that has not elected to participate in:\n(i) the contributory pension benefit option under § 31-116 of this subtitle is not subject to Title 23, Subtitle 2, Part II of this article; or\n(ii) the Alternate Contributory Pension Selection under § 31-116.1 of this subtitle is not subject to Title 23, Subtitle 2, Part III of this article.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=31-112","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"90d3cbb0eab6103cc8892830bea1e0f6d4049e359bcb7c0bcade8f9cb47c905d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-31-111.8","next":"us-md/md.-code-state-personnel-and-pensions-31-113"},"notice":"GroundRules: Original legal text.
