Code, State Personnel and Pensions § 37–202","heading":"","body":"(a) A member of a State or local retirement or pension system may transfer service credit attained as a result of that membership to another State or local retirement or pension system if the member, without incurring a break in employment, accepts employment or an office that:\n(1) requires or allows the member to participate in the new system; and\n(2) does not allow the member to continue to accrue benefits in the previous system.\n(b) A former member of a State or local retirement or pension system may transfer service credit attained as a result of the former membership to another State or local retirement or pension system if:\n(1) the former member served as an elected or appointed official while a member of the previous system;\n(2) the former member is serving as an elected or appointed official of the State when the former member requests the transfer of service credit;\n(3) a break in employment occurred that prevents the former member from transferring service credit under subsection (a) of this section; and\n(4) the former member’s current office:\n(i) requires or allows the member to participate in the new system; and\n(ii) does not allow the member to continue to accrue benefits in the previous system.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=37-202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"32ef5d791a857a99290573c153317bdadb8c0b32df8626bd7e0d46003bd92dda","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-37-201","next":"us-md/md.-code-state-personnel-and-pensions-37-203"},"notice":"GroundRules: Original legal text.
