Code, State Personnel and Pensions § 4–201","heading":"","body":"(a) This section does not apply to those units of State government with an independent personnel system.\n(b) In the State Personnel Management System the Secretary shall:\n(1) establish classes;\n(2) assign a rate of pay to each class;\n(3) ensure that each class comprises one or more positions:\n(i) that are similar in their duties and responsibilities;\n(ii) that are similar in the general qualifications required to perform those duties and responsibilities;\n(iii) to which the same standards and, if required, tests of fitness can be applied; and\n(iv) to which the same rates of pay can be applied;\n(4) give each class a descriptive classification title;\n(5) prepare a description of each class; and\n(6) (i) create additional classes; and\n(ii) abolish, combine, or modify existing classes.\n(c) The Secretary shall:\n(1) assign a class to the skilled service, professional service, management service, or executive service, as appropriate; and\n(2) designate special appointment positions in the State Personnel Management System that:\n(i) must be filled without regard to political affiliation, belief, or opinion; or\n(ii) in accordance with § 6–405(b) of this article, may be filled with regard to political affiliation, belief, or opinion.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=4-201","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"165bf1aae6c091364639fac265c9818ad40ffa1b7780039ace22968106ae282b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-4-109","next":"us-md/md.-code-state-personnel-and-pensions-4-202"},"notice":"GroundRules: Original legal text.
