Code, State Personnel and Pensions § 5–312","heading":"","body":"If, during an investigation under § 5-309(c) of this subtitle, the Secretary or Governor's designee finds that reasonable grounds exist to believe that a crime has been committed, the Secretary or Governor's designee shall:\n(1) promptly refer the matter to an appropriate prosecutor;\n(2) make all pertinent evidence available to the prosecutor; and\n(3) send to the individual believed to have committed the crime a notice that:\n(i) contains a statement of the allegation;\n(ii) notifies the individual that the matter has been referred to a prosecutor;\n(iii) advises the individual of the individual's right to obtain counsel; and\n(iv) advises the individual of the individual's right to refuse to respond to the allegation if a response might be incriminating.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=5-312","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"f6a9c34d004b71a169f3619b2fc0b6743706bc09f628f0f0870703b516e1abbe","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-5-311","next":"us-md/md.-code-state-personnel-and-pensions-5-313"},"notice":"GroundRules: Original legal text.
