Code, Transportation § 21–901.3","heading":"","body":"(a) In this section, “vulnerable individual” means:\n(1) A pedestrian, including an individual who is lawfully:\n(i) Actively working on a highway or a utility facility along a highway;\n(ii) Providing emergency services on a highway; or\n(iii) On a sidewalk or footpath;\n(2) An individual who is lawfully riding or leading an animal on a highway, shoulder, crosswalk, or sidewalk; or\n(3) An individual who is lawfully operating or riding any of the following on a highway, shoulder, crosswalk, or sidewalk:\n(i) A bicycle;\n(ii) A farm tractor or farm equipment;\n(iii) A play vehicle;\n(iv) A motor scooter;\n(v) A motorcycle;\n(vi) An animal–drawn vehicle;\n(vii) An EPAMD; or\n(viii) A wheelchair.\n(b) An individual may not cause the serious physical injury or death of a vulnerable individual as a result of the individual operating a motor vehicle in violation of any provision of this title.\n(c) (1) An individual charged with a violation of subsection (b) of this section:\n(i) Must appear in court; and\n(ii) May not prepay the fine.\n(2) An individual convicted of a violation of subsection (b) of this section is subject to a fine not exceeding $2,000.\n(d) In addition to the penalties provided under subsection (c) of this section, the court may order an individual convicted of a violation of subsection (b) of this section to:\n(1) Participate in a motor vehicle safety course; and\n(2) Perform up to 150 hours of community service.\n(e) The Administration shall suspend the driver’s license of an individual convicted of a violation of subsection (b) of this section for at least 7 days but not more than 6 months.","path":["Article - Transportation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gtr\u0026section=21-901.3","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:38Z","sha256":"eed94df9e4d67dec0ed964e4675f49621fb7172b850b1e275739e9516b2d74e2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-transportation-21-901.2","next":"us-md/md.-code-transportation-21-902"},"notice":"GroundRules: Original legal text.
