Code, Transportation § 26–402","heading":"","body":"(a) This section does not apply if the alleged offense is any of the offenses enumerated in § 26–202(a)(3)(i), (ii), (iii), and (iv) of this title.\n(b) If a police officer arrests a person and takes the person before a District Court commissioner as provided in this title, the person shall be released on issuance of a citation if:\n(1) A commissioner is not available;\n(2) A judge, clerk, or other public officer, authorized to accept bail for the court is not available; and\n(3) The person charged gives the person’s written promise to appear in court.","path":["Article - Transportation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gtr\u0026section=26-402","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:38Z","sha256":"0e1681966055ac7e85e3d0c01432832963966b0588ea96e1c742201aede43233","source_id":"us-md","stale":false,"prev":"us-md/md.-code-transportation-26-401","next":"us-md/md.-code-transportation-26-403"},"notice":"GroundRules: Original legal text.
