Code, Transportation § 8–320","heading":"","body":"(a) Before any property is condemned under this part, the Administration shall:\n(1) Complete appropriate engineering and other studies; and\n(2) Prepare a construction plan that shows:\n(i) The location of the highway to be constructed, improved, or reconstructed;\n(ii) The length of the construction; and\n(iii) The width of the right-of-way necessary for the construction.\n(b) After preparing the construction plan, the Administration shall prepare plats that include:\n(1) The construction plan;\n(2) The fee simple and easement area to be acquired, by showing:\n(i) The centerline of the construction;\n(ii) The length and termini of the construction; and\n(iii) The width of the necessary right-of-way on either side of the centerline; and\n(3) According to information obtained by the Administration, the property lines of the property owners whose property will be affected by the acquisition.\n(c) After the plats are prepared, the Administration shall:\n(1) Make the engineering and real estate studies, evaluations, and investigations necessary to determine, in its opinion:\n(i) The fair value of the property to be acquired; and\n(ii) The fair compensation for any resulting damages to the remaining property of the owner;\n(2) Prepare an estimate of this fair value and fair compensation; and\n(3) Provide for payment of these estimated amounts as required by § 8-323 of this subtitle.","path":["Article - Transportation"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gtr\u0026section=8-320","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:38Z","sha256":"34719d809c52350c4abfb5750c1a13b79860983cb235458f08ab804513e2ff7b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-transportation-8-319","next":"us-md/md.-code-transportation-8-321"},"notice":"GroundRules: Original legal text.
