A person on the ground or airborne may not use an aircraft to aid or assist in hunting:\nA.  Bear;\nB.  Deer; or\nC.  Moose.\n2.  Penalties.  The following penalties apply to this section.\nA.  A person who violates subsection 1 without the taking of a bear, deer or moose commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.\nB.  A person who violates subsection 1 and takes a bear, deer or moose commits a Class E crime for which the court shall impose a fine of not less than $500, none of which may be suspended.\nC.
