A defendant who has been sentenced but granted a stay of execution to report until a specified date or event and who, in fact, fails to report as ordered is guilty of:\nA.  A Class E crime if the underlying crime was punishable by a maximum period of imprisonment of less than one year; or\nB.  A Class C crime if the underlying crime was punishable by a maximum period of imprisonment of one year or more.\n2.  Affirmative defense.  It is an affirmative defense to prosecution under subsection 1 that the failure to report resulted from just cause.\n3.  Strict liability.
