Laws § 12.206","heading":"Assessments.","body":"Sec. 6.\n\nThe court shall order each person convicted and sentenced before October 1, 2003 of 1 or more crimes in the case to pay an assessment of $150.00 if 1 or more of the following apply:\n\nThe court is notified pursuant to section 5 that a forensic laboratory has conducted a forensic test in the investigation of the case.\n\nThe person is convicted of a CSC offense.\n\nThe assessment required under subsection (1) is in addition to any fine, costs, or other assessments imposed by the court. An assessment required under subsection (1) shall be ordered upon the record, and shall be listed separately in the judgment of sentence or order of probation.\n\nAfter reviewing a verified petition by the defendant against whom an assessment is imposed, the court may suspend payment of all or part of the assessment if it determines the defendant is unable to pay the assessment.\n\nThe court, prosecuting attorney, and originating investigating law enforcement agency may each retain 5% of all assessments or portions of assessments collected for costs incurred pursuant to this section and shall transmit that money to their respective funding units. On the last day of each month, the clerk of the court shall transmit the remainder of assessments or portions of assessments collected under this section as follows:\n\nAssessments ordered and collected before October 1, 2003 shall be transmitted to the department of treasury for deposit in the state forensic laboratory fund created in section 3.\n\nAssessments ordered before October 1, 2003, but collected on or after October 1, 2003, shall be transmitted to the state treasurer for deposit in the justice system fund created in section 181 of the revised judicature act of 1961, 1961 PA 236, MCL 600.181.","path":["MI Code","Chapter 12","Act Act-35-of-1994"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-12-206","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"08ff333014902a9411d947a8536a1c57124211a4f5b0c0a246edbd2309a91151","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-12.205","next":"us-mi/mich.-comp.-laws-12.207"},"notice":"GroundRules: Original legal text.
