Laws § 125.1610","heading":"Project plan; submission of findings and recommendations; determination of public purpose; considerations.","body":"Sec. 10.\n\nThe local public agency, if required, shall submit its findings and recommendations for approval or rejection of the project plan, with any recommendations for modification, to the governing body of the municipality for which the corporation is incorporated.\n\nThe governing body of the municipality for which the corporation is incorporated, after a public hearing on the project plan with notice of the hearing given in accordance with section 17 shall determine whether the project plan constitutes a public purpose. If it determines that the project plan constitutes a public purpose, it shall then approve or reject the plan, or approve it with modification, based on the following considerations:\n\nThe findings and recommendations of the local public agency, if required.\n\nThe findings and recommendations of the project citizens district council, if established.\n\nThat the plan meets the requirements set forth in section 8.\n\nThe persons who will be active in the management of the project for not less than 1 year after the approval of the project plan have sufficient ability and experience to manage the plan properly.\n\nThe proposed method of financing the project is feasible and the corporation has the ability to arrange the financing.\n\nThe project is reasonable and necessary to carry out the purposes of this act.","path":["MI Code","Chapter 125","Act Act-338-of-1974"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-125-1610","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"2acf3d49152b211ec1b6baa0fbcbcb53b8095cd20f6ed6a1b4f26c2ca831e2ec","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-125.1609","next":"us-mi/mich.-comp.-laws-125.1611"},"notice":"GroundRules: Original legal text.
