Laws § 15.342a","heading":"MCL 15.301 to 15.310 and MCL 15.321 to 15.330 not amended or modified; purpose of act; validity of contract in violation of act; voting on, making, or participating in governmental decisions; “governmental decision” defined.","body":"Sec. 2a.\n\nThis act shall not in any manner amend or modify the terms of Act No. 317 of the Public Acts of 1968, being sections 15.321 to 15.330 of the Michigan Compiled Laws and Act No. 318 of the Public Acts of 1968, being sections 15.301 to 15.310 of the Michigan Compiled Laws.\n\nThis act is intended as a code of ethics for public officers and employees and not as a rule of law for public contracts. A contract in respect to which a public officer or employee acts in violation of this act, shall not be considered to be void or voidable unless the contract is a violation of another statute which specifically provides for the remedy.\n\nSubject to subsection (4), section 2(6) and (7) shall not apply and a public officer shall be permitted to vote on, make, or participate in making a governmental decision if all of the following occur:\n\nThe requisite quorum necessary for official action on the governmental decision by the public entity to which the public officer has been elected or appointed is not available because the participation of the public officer in the official action would otherwise violate section 2(6) or (7).\n\nThe public officer is not paid for working more than 25 hours per week for this state or a political subdivision of this state.\n\nThe public officer promptly discloses any personal, contractual, financial, business, or employment interest he or she may have in the governmental decision and the disclosure is made part of the public record of the official action on the governmental decision.\n\nIf a governmental decision involves the awarding of a contract, section 2(6) and (7) shall not apply and a public officer shall be permitted to vote on, make, or participate in making the governmental decision if all of the following occur:\n\nAll of the conditions of subsection (3) are fulfilled.\n\nThe public officer will directly benefit from the contract in an amount less than $250.00 or less than 5% of the public cost of the contract, whichever is less.\n\nThe public officer files a sworn affidavit containing the information described in subdivision (b) with the legislative or governing body making the governmental decision.\n\nThe affidavit required by subdivision (c) is made a part of the public record of the official action on the governmental decision.\n\nAs used in this section, \"governmental decision\" means a determination, action, vote, or disposition upon a motion, proposal, recommendation, resolution, ordinance, or measure on which a vote by the members of a legislative or governing body of a public entity is required and by which a public entity formulates or effectuates public policy.","path":["MI Code","Chapter 15","Act Act-196-of-1973"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-15-342a","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"313f20ddb9453fad238bda36214122d684ceeec0fbe962c62a2960b1f1f7b96c","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-15.342","next":"us-mi/mich.-comp.-laws-15.342b"},"notice":"GroundRules: Original legal text.
