Laws § 24.306","heading":"Grounds for reversals.","body":"Sec. 106.\n\nExcept when a statute or the constitution provides for a different scope of review, the court shall hold unlawful and set aside a decision or order of an agency if substantial rights of the petitioner have been prejudiced because the decision or order is any of the following:\n\nIn violation of the constitution or a statute.\n\nIn excess of the statutory authority or jurisdiction of the agency.\n\nMade upon unlawful procedure resulting in material prejudice to a party.\n\nNot supported by competent, material and substantial evidence on the whole record.\n\nArbitrary, capricious or clearly an abuse or unwarranted exercise of discretion.\n\nAffected by other substantial and material error of law.\n\nThe court, as appropriate, may affirm, reverse or modify the decision or order or remand the case for further proceedings.","path":["MI Code","Chapter 24","Act Act-306-of-1969"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-24-306","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"b5e6520a12760447d0d8f3ff60f63a83fac3a9a1846b5d99091e52b5700469c9","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-24.305","next":"us-mi/mich.-comp.-laws-24.311"},"notice":"GroundRules: Original legal text.
