Laws § 24.422","heading":"Definitions.","body":"Sec. 2.\n\nAs used in this act:\n\n\"Constitutional taking\" or \"taking\" means the taking of private property by government action such that compensation to the owner of that property is required by either of the following:\n\nAmendment V or XIV of the constitution of the United States.\n\nSection 23 of article I and section 2 of article X of the state constitution of 1963.\n\n\"Departments\" means the departments of natural resources, environmental quality, and transportation.\n\n\"Government action\" means any of the following:\n\nA decision on an application for a permit or license.\n\nProposed rules that if promulgated or enforced may limit the use of private property.\n\nRequired dedications or exactions of private property.\n\nThe enforcement of a statute or rule, including the issuance of an order.\n\n\"Government action\" does not include any of the following:\n\nThe formal exercise of the power of eminent domain.\n\nThe forfeiture or seizure of private property by law enforcement agencies as evidence of a crime or for violations of law.\n\nThe discontinuance of government programs.\n\n\"Rule\" means a rule promulgated pursuant to the administrative procedures act of 1969, Act No. 306 of the Public Acts of 1969, being sections 24.201 to 24.328 of the Michigan Compiled Laws.","path":["MI Code","Chapter 24","Act Act-101-of-1996"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-24-422","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"e65ed02e1f7f974dd509cfd9c952f721a28c66d765865ce153df0227b09a8e07","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-24.421","next":"us-mi/mich.-comp.-laws-24.423"},"notice":"GroundRules: Original legal text.
