Laws § 28.636","heading":"Benefit payment; prohibitions.","body":"Sec. 6.\n\nA benefit payment shall not be made under this act if any of the following apply:\n\nThe personal injury that resulted in death or permanent and total disability was caused by the intentional misconduct of the public safety officer or by his or her intent to bring about the injury.\n\nThe public safety officer was voluntarily intoxicated at the time the personal injury occurred.\n\nThe public safety officer was performing his or her duties in a grossly negligent manner at the time the personal injury occurred.\n\nThe injury was the direct and proximate result of the actions of an individual to whom payment would be made under this act.","path":["MI Code","Chapter 28","Act Act-46-of-2004"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-28-636","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"7e1fa1723fb0bc2ceebacb8e6a3a482795d5ed8585d0ea1033756a79a5313375","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-28.635","next":"us-mi/mich.-comp.-laws-28.637"},"notice":"GroundRules: Original legal text.
