Laws § 320.2034","heading":"Forestry operations as public or private nuisance.","body":"Sec. 4.\n\nForestry operations shall not be found to be a public or private nuisance if the forestry operations alleged to be a nuisance conform to generally accepted forestry management practices. Generally accepted forestry management practices shall be reviewed annually by the commission and revised as considered necessary.\n\nForestry operations voluntarily using sustainable forestry practices as approved by the commission shall not be found to be a public or private nuisance if the forestry operations existed before a change in the land use or occupancy of land within 1 mile of the boundaries of the forestland, and if before that change in land use or occupancy, the forestry operations would not have been a nuisance.\n\nForestry operations that are in conformance with generally accepted forestry management practices shall not be found to be a public or private nuisance as a result of any of the following:\n\nA change in ownership or size.\n\nCessation or interruption of forestry operations.\n\nEnrollment in governmental forestry or conservation programs.\n\nAdoption of new forestry technology.\n\nAs used in this section, a public or private nuisance includes, but is not limited to, allegations of nuisance based on any of the following:\n\nVisual changes due to the removal of vegetation or timber.\n\nNoise from forestry equipment used in normal, generally accepted forestry management practices.\n\nRemoval of vegetation or timber on a forest adjoining the property of another landowner.\n\nThe use of chemicals normally utilized in forestry operations, and applied under generally accepted forestry management practices.","path":["MI Code","Chapter 320","Act Act-676-of-2002"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-320-2034","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"847948b7a90fd3817cb3ea6ab190916b9cc2416b13b16e1f81cac8d52d634e57","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-320.2033","next":"us-mi/mich.-comp.-laws-320.2035"},"notice":"GroundRules: Original legal text.
