Laws § 324.11720","heading":"Temporary variance from act.","body":"Sec. 11720.\n\n(1) The director may grant a temporary variance from a requirement of this part added by the 2004 amendatory act that amended this part if all of the following requirements are met:\n\n(a) The variance is requested in writing.\n\n(b) The requirements of this part cannot otherwise be met.\n\n(c) The variance will not create or increase the potential for a health hazard, nuisance condition, or pollution of surface water or groundwater.\n\n(d) The activity or condition for which the variance is proposed will not violate any other part of this act.\n\n(2) A variance granted under subsection (1) shall be in writing and shall be posted on the department's website.","path":["MI Code","Chapter 324","Act Act-451-of-1994"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-324-11720","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"ed59458bbdd469dc99e7e4b47e011d5ccd85c9d13cbd10c0d37c3978d303772a","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-324.11719","next":"us-mi/mich.-comp.-laws-324.11721"},"notice":"GroundRules: Original legal text.
