Laws § 324.32612","heading":"Violation; civil action; remedies; civil fine.","body":"Sec. 32612.\n\nThe department may bring a civil action against a person in the circuit court of the county in which a violation occurs or in Ingham county circuit court to do 1 or more of the following:\n\nEnforce compliance with this part and the rules promulgated under this part.\n\nRestrain a violation of this part or the rules promulgated under this part.\n\nEnjoin the further performance of, or order the removal of, any project that is undertaken contrary to this part or the rules promulgated under this part.\n\nEnforce a permit issued under this part.\n\nOrder the restoration of an area affected by a violation of this part or the rules promulgated under this part to its prior condition.\n\nIn an action brought under this section, the circuit court, in addition to any other relief granted, may assess a civil fine of not more than $5,000.00 per day for each day of violation of this part or the rules promulgated under this part.\n\nAny civil fine or remedy assessed, sought, or agreed to by the department shall be appropriate to the violation.\n\nCivil fines recovered under this section shall be forwarded to the state treasurer for deposit into the fund.","path":["MI Code","Chapter 324","Act Act-451-of-1994"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-324-32612","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"4a0b9f2b4baacfdabac0b9d6e159dffdf2e84f6cdb2204cac679ff5f257167fd","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-324.32611","next":"us-mi/mich.-comp.-laws-324.32613"},"notice":"GroundRules: Original legal text.
