Laws § 324.5532","heading":"Civil or criminal fines; factors to be considered in determining amount.","body":"Sec. 5532.\n\nA civil or criminal fine assessed, sought, or agreed upon under this part shall be appropriate to the violation.\n\nIn determining the amount of any fine levied under this part, all of the following factors shall be considered:\n\nThe size of the business.\n\nThe economic impact of the penalty on the business.\n\nThe violator's full compliance history and good faith efforts to comply.\n\nThe duration of the violation as established by any credible evidence, including evidence other than the applicable test method.\n\nPayment by the violator of penalties previously assessed for the same violation.\n\nThe economic benefit of noncompliance.\n\nThe seriousness of the violation.\n\nSuch other factors as justice may require.","path":["MI Code","Chapter 324","Act Act-451-of-1994"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-324-5532","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"07f6bc7d11429c3fb6fecd5d67706628360d260f6d3e62b9f02cbe3dd806f4b0","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-324.5531","next":"us-mi/mich.-comp.-laws-324.5533"},"notice":"GroundRules: Original legal text.
