Laws § 330.1752","heading":"Policies and procedures.","body":"Sec. 752.\n\nThe department, each community mental health services program, each licensed hospital, and each service provider under contract with the department, a community mental health services program, or a licensed hospital shall establish written policies and procedures concerning recipient rights and the operation of an office of recipient rights. The policies and procedures shall provide a mechanism for prompt reporting, review, investigation, and resolution of apparent or suspected violations of the rights guaranteed by this chapter, shall be consistent with this chapter and chapter 7a, and shall be designed to protect recipients from, and prevent repetition of, violations of rights guaranteed by this chapter and chapter 7a. The policies and procedures shall include, at a minimum, all of the following:\n\nComplaint and appeal processes.\n\nConsent to treatment and services.\n\nSterilization, contraception, and abortion.\n\nFingerprinting, photographing, audiotaping, and use of 1-way glass.\n\nAbuse and neglect, including detailed categories of type and severity.\n\nConfidentiality and disclosure.\n\nTreatment by spiritual means.\n\nQualifications and training for recipient rights staff.\n\nChange in type of treatment.\n\nMedication procedures.\n\nUse of psychotropic drugs.\n\nUse of restraint.\n\nRight to be treated with dignity and respect.\n\nLeast restrictive setting.\n\nServices suited to condition.\n\nPolicies and procedures that address all of the following matters with respect to residents:\n\nRight to entertainment material, information, and news.\n\nComprehensive examinations.\n\nProperty and funds.\n\nFreedom of movement.\n\nResident labor.\n\nCommunication and visits.\n\nUse of seclusion.\n\nAll policies and procedures required by this section shall be established within 12 months after the effective date of the amendatory act that added section 753.","path":["MI Code","Chapter 330","Act Act-258-of-1974"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-330-1752","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"83e696e09991d5292a1515d892c9d0607a8fc322ffd7c25d671361b4b5e2d85a","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-330.1750","next":"us-mi/mich.-comp.-laws-330.1753"},"notice":"GroundRules: Original legal text.
