Laws § 330.2060a","heading":"Definitions; C to J.","body":"Sec. 1060a.\n\n(1) \"Competency evaluation\" means a court-ordered examination of a juvenile directed to developing information relevant to a determination of his or her competency to proceed at a particular stage of a court proceeding involving a juvenile who is the subject of a delinquency petition.\n\n(2) \"Competency hearing\" means a hearing to determine whether a juvenile is competent to proceed.\n\n(3) \"Incompetent to proceed\" means that a juvenile, based on age-appropriate norms, lacks a reasonable degree of rational and factual understanding of the proceeding or is unable to do 1 or more of the following:\n\n(a) Consult with and assist his or her attorney in preparing his or her defense in a meaningful manner.\n\n(b) Sufficiently understand the charges against him or her.\n\n(4) \"Juvenile\" means a person who is less than 18 years of age who is the subject of a delinquency petition.","path":["MI Code","Chapter 330","Act Act-258-of-1974"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-330-2060a","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"89dda1421a10efa52df433f132901e517a87f59df4cee7268d882ac28af3491e","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-330.2060","next":"us-mi/mich.-comp.-laws-330.2060b"},"notice":"GroundRules: Original legal text.
