Laws § 333.17757b","heading":"Contracts with pharmacy benefit managers; prohibited terms.","body":"Sec. 17757b.\n\n(1) A pharmacy or pharmacist engaged in the business of selling drugs shall not enter into a contract with a pharmacy benefit manager that violates section 26 of the third party administrator act, 1984 PA 218, MCL 550.926, or that prevents or interferes with in any manner a patient's choice to receive an eligible prescription drug from a 340b entity or a pharmacy when dispensing a 340b drug.\n\n(2) As used in this section:\n\n(a) \"340b drug\" means a covered drug as that term is defined in 42 USC 256b.\n\n(b) \"340b entity\" means a covered entity as that term is defined in 42 USC 256b.\n\n(c) \"Pharmacy benefit manager\" means that term as defined in section 2 of the third party administrator act, 1984 PA 218, MCL 550.902.","path":["MI Code","Chapter 333","Act Act-368-of-1978"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-333-17757b","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"4ac6b46b6f0932015542296f6031459d082a5e0ce51eaae950c53ee6f2c006f3","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-333.17757a","next":"us-mi/mich.-comp.-laws-333.17759"},"notice":"GroundRules: Original legal text.
