Laws § 333.22249","heading":"Agreement authorizing hospital to lease space and operate beds in another hospital; conditions.","body":"Sec. 22249.\n\nSubject to subsection (2), if a hospital has a high occupancy rate, as determined by the department, and if the hospital applies for and is issued a certificate of need for an increase in licensed bed capacity, the department may enter into an agreement with the hospital that would authorize the hospital to lease space and operate beds in another hospital in the same planning area, if the other hospital has a low occupancy rate, as determined by the department.\n\nThe department may enter into an agreement authorized under subsection (1) only if all of the following apply:\n\nThe hospital issued a certificate of need has a documented history of high occupancy.\n\nThe alternative of redistributing the beds within the hospital's licensed bed capacity does not exist.\n\nThe agreement will not change the overall supply of beds within the planning area.\n\nNew construction is not required.\n\nThe department determines that the agreement is necessary to protect the public health, safety, and welfare.","path":["MI Code","Chapter 333","Act Act-368-of-1978"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-333-22249","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"ed0a24f968462756662d2dd072593dd2eb5ff5740c1345f6986d2c04a6f2bb7c","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-333.22247","next":"us-mi/mich.-comp.-laws-333.22253"},"notice":"GroundRules: Original legal text.
