Laws § 333.2431","heading":"Local health department; requirements; report; reviewing plan for organization of local health department; waiver.","body":"Sec. 2431.\n\nA local health department shall:\n\nHave a plan of organization approved by the department.\n\nDemonstrate ability to provide required services.\n\nDemonstrate ability to defend and indemnify employees for civil liability sustained in the performance of official duties except for wanton and wilful misconduct.\n\nMeet the other requirements of this part.\n\nEach local health department shall report to the department at least annually on its activities, including information required by the department.\n\nIn reviewing a plan for organization of a local health department, the department shall consider the fiscal capacity and public health effort of the applicant and shall encourage boundaries consistent with those of planning agencies established pursuant to federal law.\n\nThe department may waive a requirement of this section during the option period specified in section 2422 based on acceptable plan development during the planning period described in section 2424 and thereafter based on acceptable progress toward implementation of the plan as determined by the department.","path":["MI Code","Chapter 333","Act Act-368-of-1978"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-333-2431","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"291d21eeb174fa096584a5dfaeddf9b03242c74b37aaa8214fa2b96e08f4fdde","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-333.2428","next":"us-mi/mich.-comp.-laws-333.2433"},"notice":"GroundRules: Original legal text.
