Laws § 336.104","heading":"List of restricted use chlorofluorocarbon compounds; determination of exemptions; specific exemptions; rules generally.","body":"Sec. 4.\n\nThe department shall:\n\nAfter hearings, prepare a list of restricted use chlorofluorocarbon compounds, the distribution, sale, offer and exposure for sale of which in this state shall be restricted as determined pursuant to sections 2 and 3.\n\nDetermine, after a hearing, whether any uses, including medical uses, of restricted use chlorofluorocarbon compounds are so necessary to human life that they should be exempted from the application of section 3.\n\nThe following are specifically exempted from this act:\n\nAn aerosol spray device containing a restricted use chlorofluorocarbon compound which contains 1 or more drugs as defined in section 4(6) of Act No. 196 of the Public Acts of 1971, being section 335.304 of the Michigan Compiled Laws, which is administered by a metered spray valve for the treatment of asthma or other respiratory diseases.\n\nAn aerosol spray device containing a restricted use chlorofluorocarbon compound sold or manufactured for use as a prescription drug or in a surgical procedure.\n\nThe department shall promulgate rules pursuant to Act No. 306 of the Public Acts of 1969, as amended, necessary to carry out and give full force and effect to this act.","path":["MI Code","Chapter 336","Act Act-384-of-1976"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-336-104","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"00d980be56b73f4afb2f9054418a2bd14fa90ea778c2f582014265e385b72543","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-336.103","next":"us-mi/mich.-comp.-laws-336.105"},"notice":"GroundRules: Original legal text.
