Laws § 37.1211","heading":"Powers of person under article.","body":"Sec. 211.\n\nA person may, under this article, do 1 or more of the following:\n\nEstablish employment policies, programs, procedures, or work rules regarding the use of alcoholic liquor or the illegal use of drugs.\n\nApply different standards of compensation, or different terms, conditions, or privileges of employment pursuant to a bona fide seniority or merit system, transfer system, scheduling system, assignment system, or attendance plan if those standards of compensation or terms, conditions, or privileges of employment are not a subterfuge to evade the purposes of this article.\n\nEstablish uniform policies requiring employees who have been absent from work because of illness or injury to submit evidence of the ability to return to work. This subdivision does not allow a person to establish a policy requiring only persons with disabilities to submit evidence of the ability to return to work.\n\nEither of the following:\n\nProhibit an employee who is being compensated under the worker's disability compensation act of 1969, 1969 PA 317, MCL 418.101 to 418.941, for an injury arising out of and in the course of his or her employment with that person from returning to work in a restructured job.\n\nRequire an employee who is being compensated under the worker's disability compensation act of 1969, 1969 PA 317, MCL 418.101 to 418.941, for an injury arising out of and in the course of his or her employment with that person to return to work as provided by law, if the person accommodates the employee as required under this article.","path":["MI Code","Chapter 37","Act Act-220-of-1976"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-37-1211","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"d0160be012a6957b3bd7368cd38f5b742a13f3af097a401aadee6ce1775b6c81","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-37.1210","next":"us-mi/mich.-comp.-laws-37.1212"},"notice":"GroundRules: Original legal text.
