Laws § 38.1006","heading":"“Member” defined.","body":"Sec. 6.\n\nExcept as otherwise provided in subsection (2), \"member\" means any of the following:\n\nA legislator of this state.\n\nThe secretary of the senate who served not less than 6 months before January 1, 1979, and for not less than 3 months after January 1, 1979.\n\nThe clerk of the house who served not less than 6 months before January 1, 1979, and for not less than 3 months after January 1, 1979.\n\nThe lieutenant governor.\n\nMember does not include any of the following:\n\nAn individual who elects not to participate in the retirement system under section 18.\n\nAn individual who first becomes a legislator or lieutenant governor on or after March 31, 1997.\n\nAn individual who elects to terminate membership under section 61 and who, but for that election, would otherwise be eligible for membership in Tier 1 under section 18.","path":["MI Code","Chapter 38","Act Act-261-of-1957"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-38-1006","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"c81098df8f2b7fc9ea9a5553f686292a21152fcb499d3b7e5786a0e9daec2db0","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-38.1005","next":"us-mi/mich.-comp.-laws-38.1007a"},"notice":"GroundRules: Original legal text.
