Laws § 38.2308","heading":"Offsetting benefits against amounts owed; forfeiture of service credit for transfer to federal agency; rights subject to public employee retirement benefit protection act.","body":"Sec. 308.\n\nThe retirement system may offset retirement benefits or refunds payable under this act against amounts owed to the retirement system by a member, vested former member, retirant, retirement allowance beneficiary, or refund beneficiary.\n\nIf the retirement system is required by the federal government pursuant to a court order to transmit a part of a member's accumulated contributions to a federal agency, the service credit that is covered by the payment shall be forfeited in the same manner as if the employee had requested and been paid a refund of the member's most recent contributions.\n\nThe right of a person to a retirement allowance, to the return of accumulated contributions, to an optional benefit, to any other right accrued or accruing to a member or beneficiary under this act, and to the money belonging to the retirement system is subject to the public employee retirement benefit protection act.","path":["MI Code","Chapter 38","Act Act-234-of-1992"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-38-2308","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"57cf4421485fa11e8901aa1993dc4a0ccb1d204f9b3e2b61d7f1385452b7641b","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-38.2307","next":"us-mi/mich.-comp.-laws-38.2401"},"notice":"GroundRules: Original legal text.
