Laws § 380.392","heading":"Opening of new school prohibited; circumstances.","body":"Sec. 392.\n\nThe board of a community district shall not open a new school if both of the following circumstances exist:\n\n(a) The proposed school would operate at the same location as a public school that currently is on the list under federal accountability requirements as provided under the every student succeeds act, Public Law 114-95, of the public schools in this state determined to be among the lowest achieving 5% of public schools in this state or has been on the list under federal accountability requirements as provided under the every student succeeds act, Public Law 114-95, during the immediately preceding 3-year period of the public schools in this state determined to be among the lowest achieving 5% of public schools in this state.\n\n(b) The proposed school would have substantially the same leadership and substantially the same curriculum offerings as the school that previously operated at that location.","path":["MI Code","Chapter 380","Act Act-451-of-1976"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-380-392","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"70a7bd353c8d9da97a2f7a2414151237baaf38a6d79b60849cb058cd02118621","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-380.389","next":"us-mi/mich.-comp.-laws-380.393"},"notice":"GroundRules: Original legal text.
