Laws § 436.1914b","heading":"Marihuana-infused beer, wine, mixed wine drink, mixed spirit drink, or spirits; use, possession, sale, or offer for sale prohibited; exception; definitions.","body":"Sec. 914b.\n\n(1) Except as otherwise provided in subsection (2), a person shall not use or offer for use, possess, sell, or offer for sale marihuana-infused beer, wine, mixed wine drink, mixed spirit drink, or spirits. A person that violates this section is guilty of a misdemeanor punishable as provided in section 909.\n\n(2) This section does not apply to a hospital that operates primarily for the purpose of conducting scientific research, a state institution conducting bona fide research, a private college or university conducting bona fide research, or a pharmaceutical company or biotechnology company conducting bona fide research.\n\n(3) As used in this section:\n\n(a) \"Marihuana\" means that term as defined in section 3 of the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333.27953.\n\n(b) \"Marihuana-infused beer, wine, mixed wine drink, mixed spirit drink, or spirits\" means beer, wine, mixed wine drink, mixed spirit drink, or spirits that contain any amount of marihuana.","path":["MI Code","Chapter 436","Act Act-58-of-1998"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-436-1914b","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"4ec74abada69ae77a14a872e6b7ad9b6f63c669a60393ef0defb2e75b50b3b0d","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-436.1914a","next":"us-mi/mich.-comp.-laws-436.1915"},"notice":"GroundRules: Original legal text.
