Laws § 440.2314","heading":"Implied warranty; merchantability, course of dealing, usage of trade.","body":"Sec. 2314.\n\nUnless excluded or modified (section 2316), a warranty that the goods shall be merchantable is implied in a contract for their sale if the seller is a merchant with respect to goods of that kind. Under this section the serving for value of food or drink to be consumed either on the premises or elsewhere is a sale.\n\nGoods to be merchantable must be at least such as\n\npass without objection in the trade under the contract description; and\n\nin the case of fungible goods, are of fair average quality within the description; and\n\nare fit for the ordinary purposes for which such goods are used; and\n\nrun, within the variations permitted by the agreement, of even kind, quality and quantity within each unit and among all units involved; and\n\nare adequately contained, packaged, and labeled as the agreement may require; and\n\nconform to the promises or affirmations of fact made on the container or label if any.\n\nUnless excluded or modified (section 2316) other implied warranties may arise from course of dealing or usage of trade.","path":["MI Code","Chapter 440","Act Act-174-of-1962"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-440-2314","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"8b1a7c7fa74f48b55d0f3cc30a4dc6a8a6304afd3af66dd53ddb5a1d61fc8613","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-440.2313b","next":"us-mi/mich.-comp.-laws-440.2315"},"notice":"GroundRules: Original legal text.
