Laws § 440.9618","heading":"Rights and duties of certain secondary obligors.","body":"Sec. 9618.\n\nA secondary obligor acquires the rights and becomes obligated to perform the duties of the secured party after all of the following:\n\nThe secondary obligor receives an assignment of a secured obligation from the secured party.\n\nThe secondary obligor receives a transfer of collateral from the secured party and agrees to accept the rights and assume the duties of the secured party.\n\nThe secondary obligor is subrogated to the rights of a secured party with respect to collateral.\n\nAn assignment, transfer, or subrogation described in subsection (1) results in both of the following:\n\nIt is not a disposition of collateral under section 9610.\n\nIt relieves the secured party of further duties under this article.","path":["MI Code","Chapter 440","Act Act-174-of-1962"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-440-9618","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"12e38d191e92a3471b326888c94237bddb7e3cd8073450f02a10052587ef8682","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-440.9617","next":"us-mi/mich.-comp.-laws-440.9619"},"notice":"GroundRules: Original legal text.
