Laws § 445.2508","heading":"Civil action; recovery; costs and attorney fees.","body":"Sec. 8.\n\nA civil action may be brought by a person who received an unsolicited commercial e-mail in violation of this act.\n\nA civil action may be brought by an e-mail service provider through whose facilities the unsolicited commercial e-mail was transmitted in violation of this act.\n\nA civil action may be brought by the attorney general against a person who has violated this act.\n\nIn each action brought under this section, a recipient, e-mail service provider, or attorney general may recover 1 of the following:\n\nActual damages.\n\nIn lieu of actual damages, recover the lesser of the following:\n\n$500.00 per unsolicited commercial e-mail received by the recipient or transmitted through the e-mail service provider.\n\n$250,000.00 for each day that the violation occurs.\n\nThe prevailing recipient or e-mail service provider shall be awarded actual costs and reasonable attorney fees.","path":["MI Code","Chapter 445","Act Act-42-of-2003"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-445-2508","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"cc108f9150545c923c1b98f6cd37ee0dcc5da3a0bfd7275a7efca6e2c4a1ddfb","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-445.2507","next":"us-mi/mich.-comp.-laws-445.951"},"notice":"GroundRules: Original legal text.
