Laws § 445.72b","heading":"Misrepresentation by advertisement or solicitation prohibited; violation as misdemeanor; penalty; civil remedy.","body":"Sec. 12b.\n\n(1) A person shall not distribute an advertisement or make any other solicitation that misrepresents to the recipient that a security breach has occurred that may affect the recipient.\n\n(2) A person shall not distribute an advertisement or make any other solicitation that is substantially similar to a notice required under section 12(5) or by federal law, if the form of that notice is prescribed by state or federal law, rule, or regulation.\n\n(3) A person who knowingly or intentionally violates this section is guilty of a misdemeanor punishable as follows:\n\n(a) Except as otherwise provided in subdivisions (b) and (c), by imprisonment for not more than 93 days or a fine of not more than $1,000.00 for each violation, or both.\n\n(b) For a second violation, by imprisonment for not more than 93 days or a fine of not more than $2,000.00 for each violation, or both.\n\n(c) For a third or subsequent violation, by imprisonment for not more than 93 days or a fine of not more than $3,000.00 for each violation, or both.\n\n(4) Subsection (3) does not affect the availability of any civil remedy for a violation of this section or any other state or federal law.","path":["MI Code","Chapter 445","Act Act-452-of-2004"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-445-72b","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"ce9ce62bdea6b1212024e52c8399c5bab76b5b1534ab94ab0aafb1e11cf8617b","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-445.72a","next":"us-mi/mich.-comp.-laws-445.73"},"notice":"GroundRules: Original legal text.
