Laws § 460.1333","heading":"Bonding requirements; limitations.","body":"Sec. 33.\n\n(1) As a condition of a permit described in this act, an authority may adopt bonding requirements for small cell wireless facilities if both of the following requirements are met:\n\n(a) The authority imposes similar requirements in connection with permits issued for similarly situated users of the ROW.\n\n(b) The purpose of the bonds is 1 or more of the following:\n\n( i ) To provide for the removal of abandoned or improperly maintained small cell wireless facilities, including those that an authority determines should be removed to protect public health, safety, or welfare.\n\n( ii ) To repair the ROW as provided under section 13(10).\n\n( iii ) To recoup rates or fees that have not been paid by a wireless provider in more than 12 months, if the wireless provider has received 60-day advance notice from the authority of the noncompliance.\n\n(2) An authority shall not require either of the following under subsection (1):\n\n(a) A cash bond, unless any of the following apply:\n\n( i ) The wireless provider has failed to obtain or maintain a bond required under this section.\n\n( ii ) The surety has defaulted or failed to perform on a bond given to the authority on behalf of the wireless provider.\n\n(b) A bond in an amount exceeding $1,000.00 per small cell wireless facility.","path":["MI Code","Chapter 460","Act Act-365-of-2018"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-460-1333","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"959b7827d9b9900232c7486514708ff07ef93b6a2f4868a2c58ebfd1961ef39e","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-460.1331","next":"us-mi/mich.-comp.-laws-460.1335"},"notice":"GroundRules: Original legal text.
