Laws § 500.3406w","heading":"Temporary emergency and early refills for prescription drugs; inapplicable after March 31, 2021.","body":"Sec. 3406w.\n\n(1) Beginning on the effective date of the amendatory act that added this section, an insurer that delivers, issues for delivery, or renews in this state a health insurance policy that provides coverage for prescription drugs shall do both of the following:\n\n(a) Provide coverage for an emergency refill of up to a 60-day supply of any covered maintenance prescription drug.\n\n(b) Provide coverage for an early refill of any 30-day or 60-day covered maintenance prescription drug to allow for up to a 90-day supply, without regard to whether the pharmacy is mail order or in person.\n\n(2) This section does not apply after March 31, 2021.\n\n(3) As used in this section:\n\n(a) \"Emergency refill\" means a refill where, in the pharmacist's professional judgment, failure to refill the prescription may interrupt the patient's ongoing care and have a significant adverse effect on the patient's well-being as provided in section 17713 of the public health code, 1978 PA 368, MCL 333.17713.\n\n(b) \"Maintenance prescription drug\" means a prescription drug that meets the requirements under section 3406t(1)(b)( i ) to ( iii ).","path":["MI Code","Chapter 500","Act Act-218-of-1956"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-500-3406w","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"2172b5b18a92d7dfb8ed7adc96732a17877b5c4e35fdb886958932778ae787dd","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-500.3406v","next":"us-mi/mich.-comp.-laws-500.3406x"},"notice":"GroundRules: Original legal text.
