Laws § 550.1807","heading":"Eligibility of parent for dependent coverage; health coverage of child through noncustodial parent; duties of plan administrator; court or administrative order and notice required.","body":"Sec. 7.\n\nIf a parent is eligible for dependent coverage through a plan, the plan administrator shall:\n\nPermit the parent to enroll, under the dependent coverage, a child who is otherwise eligible for coverage without regard to any enrollment season restrictions.\n\nIf the parent is enrolled but fails to make application to obtain coverage for the child, enroll the child under dependent coverage upon application by the friend of the court or by the child's other parent through the friend of the court.\n\nNot eliminate the child's coverage unless premiums have not been paid as required by the plan or the plan administrator is provided with satisfactory written evidence of either of the following:\n\nThe court or administrative order is no longer in effect.\n\nThe child is or will be enrolled in comparable health coverage through another plan, insurer, health care corporation, or health maintenance organization that will take effect not later than the effective date of the cancellation of the existing coverage.\n\nIf a child has health coverage through the plan of a noncustodial parent, that plan administrator shall do all of the following:\n\nProvide the custodial parent with information necessary for the child to obtain benefits through that coverage.\n\nPermit the custodial parent or, with the custodial parent's approval, the provider to submit a claim for covered services without the noncustodial parent's approval.\n\nMake payment on claims submitted under subdivision (b) directly to the custodial parent or medical provider.\n\nThis section applies only if a parent is required by a court or administrative order to provide health coverage for a child and the plan is notified of that court or administrative order.","path":["MI Code","Chapter 550","Act Act-239-of-1995"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-550-1807","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"b37ac333da902cd6fa3131b09981480708c3a0645435e604f975039d9bdc6287","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-550.1805","next":"us-mi/mich.-comp.-laws-550.1809"},"notice":"GroundRules: Original legal text.
