Laws § 550.528","heading":"Order prohibiting provider from entering viatical settlement contract; additional orders.","body":"Sec. 8.\n\nThe commissioner may issue an order prohibiting the provider from entering into a viatical settlement contract in this state if the commissioner finds any of the following:\n\nThe provider has been fraudulent or engaged in dishonest practices.\n\nThe provider demonstrates a pattern of unreasonable payments to policy owners.\n\nThe provider has been convicted of a felony or any misdemeanor that involved criminal fraud.\n\nThe provider has violated a provision of this act.\n\nIn addition to the order under subsection (1), the commissioner may order any of the following:\n\nPayment of a civil fine of not more than $500.00 for each violation.\n\nIf the provider knew or reasonably should have known that the provider was in violation of this act, the repayment of all consideration paid by or on behalf of a viator for a viatical settlement contract affected by the violation and a civil fine of not more than $2,500.00 for each violation.\n\nA cease and desist order.","path":["MI Code","Chapter 550","Act Act-386-of-1996"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-550-528","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"657ea29578f4e25e39b7a2b7aae8708c4d3ac314d497d83059d83c4d728dd82f","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-550.527","next":"us-mi/mich.-comp.-laws-550.701"},"notice":"GroundRules: Original legal text.
